These Terms of Service (“Terms”) govern your relationship with Shirka Corporation S.A., operating as Americas Sportsbook, and its subsidiaries, representatives, affiliates, officers, and directors (collectively, “Americas Sportsbook,” “we,” “us,” or “our”) in relation to your use of our applications, websites, and related services (collectively, the “Services”). By using our mobile applications, third-party social networking services, websites, or any services offered therein, you agree to be bound by these Terms. These Terms are a binding legal agreement between you and Americas Sportsbook, and they apply to all modifications made to them.

By using our services, you represent that you are not prohibited from receiving products originating from the United States or the European Union.

You do not own any virtual currency or items purchased or earned through our services, and you may not transfer or sell them outside of our platform. Any unauthorized transfer is prohibited and may result in account termination.

App Stores

Our applications may be available through third-party app stores, such as the Apple App Store or Google Play. These stores are not responsible for providing our services, and any issues should be directed to Americas Sportsbook. The terms of use for these stores may also apply.

iOS Terms

You acknowledge and agree that (i) these Terms are binding between you and Shirka Corporation S.A. only, and Apple is not a party hereto, and (ii) as between Shirka Corporation S.A. and Apple, it is Shirka Corporation S.A. that is responsible for the application and the content thereof. You must use the iOS version of the application only on an Apple-branded product that runs iOS. Your use of the iOS version of the application must comply with the terms of use applicable to the Apple source from which you obtain it (including the “Usage Rules” set forth in the Apple App Store Terms of Service). You acknowledge that Apple has no obligation to furnish you with any maintenance and support services with respect to the application.

You acknowledge that Apple is not responsible for addressing any claims you have or any claims of any third party relating to the application or your possession and use of the application, including, but not limited to, (i) product warranty or liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection or similar legislation; or (iv) claims that the application infringes a third party’s intellectual property rights.

In the event of any failure of the iOS version of the application to conform to any applicable warranty that has not been effectively disclaimed by these Terms, you may notify Apple, and Apple will refund the purchase price for the application (if any) to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and, as between Apple and Shirka Corporation S.A., any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Shirka Corporation S.A.’s responsibility, but only to the extent provided by these Terms. Please read the entire Terms, as other sections of these Terms limit Shirka Corporation S.A.’s liability in this regard.

Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third-party beneficiary thereof.

User Obligations

You agree to provide accurate information when using our services and to comply with all applicable laws. Americas Sportsbook may require you to accept updates to our services, and you acknowledge that updates may be necessary to continue using the services.

General Prohibitions

You agree not to use our services for any unlawful purpose or in a manner that violates these Terms. Prohibited activities include, but are not limited to, defrauding Americas Sportsbook or other users, posting harmful content, and using cheats or hacks. Americas Sportsbook reserves the right to terminate accounts and take legal action against users who violate these prohibitions.

Limits on Liability

Americas Sportsbook is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you have paid to us in the 180 days preceding your claim. You agree that your sole remedy for any dispute is to stop using our services and cancel your account.

Content and User Content

By posting content on our services, you grant Americas Sportsbook the right to use, modify, and distribute your content. You are responsible for ensuring that your content does not violate any rights of third parties. Americas Sportsbook reserves the right to remove or edit any content that violates these Terms.

Third-Party Advertisers and Websites

Americas Sportsbook is not responsible for the content or services provided by these third parties, and you access them at your own risk. America's Sportsbook advertising may include advertisements that include affiliate links, where any purchase you make might result in financial compensation to Shirka Corporation S.A.

Intellectual Property Rights

All content on our services, including games, software, and trademarks, is protected by intellectual property laws. You may not use, copy, or distribute any content without our permission. Unauthorized use may result in legal action.

Indemnification

You agree to indemnify Americas Sportsbook and its affiliates against any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any rights.

General Acknowledgments

Americas Sportsbook may modify or discontinue services at any time without notice. We are not responsible for any loss of data or content resulting from your use of our services. These Terms are governed by the laws of Panama, and any legal action must be brought within six months of the cause of action.

Disclaimer of Warranties

Notice and Procedure for Copyright Infringement

If you believe that your intellectual property rights have been violated, you may file a claim with Americas Sportsbook. We reserve the right to terminate accounts of repeat infringers.

Governing Law

These Terms are governed by the laws of Panama, and any legal disputes must be resolved in the courts of Panama.
